About David
David Frydrych served as Senior Lecturer in the Faculty of Law at Monash University from 2020 to April 2025. In this role, he taught courses such as Principles of Trusts (LAW5010), Property, and Legal Philosophy (LAW4137). A Canadian national admitted to practice law in the State of New York, Frydrych's academic background includes a DPhil in Law from the University of Oxford Faculty of Law and Somerville College, completed in 2016; a JD from the Benjamin N. Cardozo School of Law; and a BA (Hons) and LLM from the University of Toronto. Prior to his appointment at Monash, he held postdoctoral fellowships at the National University of Singapore Faculty of Law from August 2016 to July 2018 and at New York University School of Law. His doctoral research at Oxford focused on theories of rights, forming the basis for subsequent publications.
Frydrych's research specializations lie in jurisprudence, with particular emphasis on theories of rights, rights correlativity, rights modelling, legal realism, and the will theory of rights, alongside trusts law focusing on international discretionary trusts, offshore financial centres, trustees' rights of indemnity, and property rights. He is the author of the monograph The Architecture of Rights: Models and Theories (Palgrave Macmillan, 2021), which examines the philosophical foundations of rights, critiques existing models and theories, and addresses issues such as rights exercise, enforcement, imperfect rights, and perimeters of support. Key peer-reviewed articles include 'The Case Against the Theories of Rights' in the Oxford Journal of Legal Studies (2020), 'Hohfeld vs. the Legal Realists' in Legal Theory (2018), 'The Theories of Rights Debate' in Jurisprudence (2018), 'What is the Will Theory of Rights?' in Ratio Juris (2019), 'Rights Modelling' in the Canadian Journal of Law & Jurisprudence (2017), 'Kramer's Delimiting Test for Legal Rights' in the American Journal of Jurisprudence (2017), and 'Realism and Positivism' (2022). Frydrych presented his research at the Monash Tax Symposium in 2021. His scholarship contributes to ongoing debates in legal philosophy, private law, and obligations.
