About Krish

Krish Maharaj is an Associate Professor in the Faculty of Law at Thompson Rivers University. He holds an LLB and BCom from the University of Auckland, an LLM from the University of British Columbia, and a PhD from UBC. Admitted to the bars of New Zealand, British Columbia, and Alberta, he brings a practitioner-focused approach to his teaching and research. Prior to joining TRU, Dr. Maharaj served as a full-time faculty member at the University of Manitoba Faculty of Law, where he led the establishment of the Desautels Centre for Private Enterprise and Law and helped develop a joint JD-MBA program.

Dr. Maharaj's research specializes in the law of obligations and private law relationships, including contracts, equity and trusts, civil remedies, private enterprise, gain-based damages for breach of contract, the doctrine of mitigation in damages assessment, intersections of obligation law with equity and damages law, and good faith obligations in Anglo-Canadian contract law. His publications include the forthcoming book A More Equitable Approach to Mitigation (Hart Publishing), articles such as "How do Limitation Clauses, Damages, and Good Faith Duties Align?" (Canadian Bar Review, in press), "Pre-Existing Legal Relationships in Promissory Estoppel Ought Not Be Understood So Restrictively" (2023, 1:1 TRU L Rev 9), "Alternatives to Expectation: When Can You Get Disgorgement, Gain-Based, or Restitutionary Damages for Breach of Contract" (2022, 48:1 Queen's LJ 120), "Good Faith Not Good for Consistency: Irreconcilable Results in Wastech and Callow" (2022, 55 UBC L Rev 511), and co-authored chapters on contracts in the Annual Review of Law & Practice (2021-2024). His work has been quoted in submissions to the Supreme Court of Canada and cited by the Court. He teaches Contract Law (LAWF 3030) and Business Associations (LAWF 3800), and has presented at events including the Obligations X Conference (2023), National Judicial Institute Civil Law Seminar (2022), and Supreme Court of British Columbia Education Seminar (2024).
