Anna Giardina is an Associate Lecturer in the Curtin Law School within the Faculty of Business and Law at Curtin University. The work details fraudulent phoenix activity, defined as the deliberate liquidation of a company to avoid payment of liabilities such as employee superannuation guarantee contributions, wages, taxes, workers' compensation premiums, and long service leave to creditors. It discusses the scale and prevalence in Australia, consequences including employee losses leading to greater reliance on aged pensions, creditor recovery challenges, and government revenue shortfalls, and proposes reforms like improved online reporting between the Australian Taxation Office and companies to safeguard superannuation entitlements.
