Iain Stewart is an Honorary Associate Professor in Macquarie Law School at Macquarie University. He earned his LLB (Hons) from the University of Exeter in 1969, Diplôme de droit comparé (1er cycle) and (2me cycle) from the International Faculty for the Teaching of Comparative Law in 1968 and 1969, respectively, and PhD in Jurisprudence from University College London in 1982, with the thesis Law and Custom: Critique of Right. His academic career began as Lecturer in Law at the University of Hull from 1980 to 1985, followed by Lecturer in Sociology at the same institution from 1985 to 1987. Since joining Macquarie University in 1987 as Lecturer in Law, he advanced to Senior Lecturer from 1990 to 2008—during which he served as Head of the School of Law from 1990 to 1991—Associate Professor of Law from 2008 to 2015, and Honorary Fellow thereafter.
Stewart's research focuses on the theory of law, history of law and administration, jurisprudence, and the works of Hans Kelsen. Notable publications include Montesquieu in England: his 'Notes on England', with commentary and translation (2002); Men of Class: Aristotle, Montesquieu and Dicey on 'Separation of Powers' and 'The Rule of Law' (2004); From 'Rule of Law' to 'Legal State': A Time of Reincarnation? (2007); Kelsen's Reception in Australasia (2010); Mors Codicis: End of the Age of Codification? (2012); Hans Kelsen, Legal Scientist (2023); and Kelsen the Outsider (2025). He holds memberships as Associate Member of the International Academy of Comparative Law, elected in 2009, and International Correspondent for the Hans Kelsen-Institut in Vienna since 2012. His scholarship addresses critical legal science, comparative law, the rule of law, and philosophical underpinnings of legal norms, contributing to ongoing debates in legal philosophy.
