About Jemimah
Dr Jemimah Roberts is a Lecturer at Macquarie Law School, Macquarie University. She is a comparative constitutional law scholar interested in the concept of constitutional ‘borrowing’, with a particular focus on the relationship between the US and Australian constitutional systems. Her current research explores the implied freedom of political communication, the intersection between free speech and religious liberty, and the approach to stare decisis in apex courts such as the High Court of Australia and the Supreme Court of the United States. She has published on topics including freedom of expression in the digital landscape, the role of foreign law in domestic constitutional adjudication, and presidential disability and removal. Prior to academia, she was a solicitor in a global law firm in Sydney, Australia, and is admitted as a solicitor of the Supreme Court of New South Wales.
Dr Roberts earned her PhD from the University of New South Wales with a dissertation titled “The Use of American Precedent in Australian Constitutional Jurisprudence”. She holds a Bachelor of Laws with First Class Honours and a Bachelor of Arts in Government and International Relations from the University of Sydney, as well as a Graduate Diploma of Legal Practice from the College of Law, NSW. Her key publications include “Combatting mis and disinformation in the digital age: challenges and opportunities for Australia” in Griffith Law Review (2025, with Shireen Morris and Sarah Sorial), “The limits of weakened stare decisis: cautionary lessons from the United States for Australia” in University of Queensland Law Journal (2026, with Ashleigh Barnes), “Recapping 2025: uncertainty and contention afflicts the implied freedom doctrine” in LSJ Online (2026, with Shireen Morris), and “Access, accountability and the Constitution: rethinking the normative and democratic foundations of Freedom of Information Laws in Australia” submitted to The University of New South Wales Law Journal (2026, with Danielle Moon and Shireen Morris). She has delivered presentations on stare decisis in the US Supreme Court, overruling constitutional precedent, and policy brief writing in administrative law.
