Associate General Counsel for Student Affairs & Employment Matters

We are seeking a highly skilled and self-motivated Associate General Counsel for Student Affairs & Employment Matters who will serve as a trusted legal advisor and work in the Student Affairs and Employment Matters (SAEM) Practice Group within the Office of the Vice President and General Counsel (OGC). The Associate General Counsel will report to and support the Co-Practice Group Leaders in the SAEM Practice Group but will also have independent responsibility for a variety of legal matters. The Associate General Counsel will work closely with Human Resources, Student Affairs and Athletics and other schools and departments across campus and will be responsible for providing legal advice and counsel on a wide range of labor and employment matters, as well as issues impacting students and student life, while taking care to align strategies with the university’s mission and priorities. The desired candidate will have excellent communication skills and be willing to collaborate with other attorneys within the OGC and with institutional clients to accomplish the goals of the university. The Associate General Counsel will be knowledgeable in both federal and state employment laws and regulations, as well as laws and regulations impacting students, including student-athletes.

Specific Duties & Responsibilities

  • Provide advice and counsel regarding a broad array of labor and employment matters, including faculty appointments, staff and student-employee hiring, progressive discipline, separations, compensation, benefits, leaves of absence, disability and religious accommodations, grievances and reductions-in-force, professional misconduct and tenure review and revocation, working closely with the provost’s office and central and divisional human resources as appropriate.
  • Regularly advise Student Affairs personnel regarding housing, religious and disability accommodations, student conduct and disciplinary proceedings, student organizations, students of concern and threat assessment, leaves of absence, grievances, admissions revocations and records requests.
  • Provide legal advice to Athletics regarding NCAA and Title IX compliance, risk management, student athlete recruitment and eligibility, and name-image-and-likeness issues.
  • Counsel and advise the Office of Institutional Equity regarding discrimination, harassment, retaliation and sexual misconduct in accordance with state law, Title VI, Title VII, Title IX, ADA, ADEA, and provide support regarding internal complaints and investigations required by applicable university policy.
  • Review and draft policies, procedures and rules impacting faculty, staff and students and advise university constituents regarding policy requirements.
  • Prepare position statements for submission to administrative agencies, including the U.S. Equal Employment Opportunity Commission, the U.S. Office for Civil Rights, the U.S. Department of Labor and state agencies, including the Maryland Commission on Civil Rights.
  • Provide training to faculty and staff regarding a variety of matters, including institutional policies, federal and state law and regulations.

Minimum Qualifications

  • J.D. from an accredited law school.
  • Must be licensed to practice law in at least one U.S. jurisdiction. If not licensed in Maryland, must be eligible for admission within twelve (12) months.

Required Experience

  • A minimum of five (5) years of experience practicing labor and employment law.
  • Strong knowledge of labor and employment laws, including Title VII, FLSA, ADA, ADEA, FMLA and other employment-related statutes and regulations.
  • Significant experience advising on matters involving students and student life, including FERPA, the Clery Act and state law.
  • Excellent communication, writing and analytical skills.
  • Demonstrated ability to meet deadlines and to prioritize multiple and competing projects.
  • Ability to demonstrate good judgment.
  • Additional education may substitute for required experience and additional related experience may substitute for required education beyond HS Diploma/Graduation Equivalent, to the extent permitted by the JHU equivalency formula.

Preferred Qualifications

  • A minimum of seven (7) years of experience providing legal counsel to an institution of higher education
  • Prior in-house counsel experience advising on both labor and employment matters, and matters involving students and student life
  • Experience advising on Title VI and Title IX
